Welcome to Funnel MasteryX. All our services are subject to the notices, terms and conditions set forth in this agreement. When using any Funnel MasteryX service, the customer will be subject to the rules, guidelines, policies, terms and conditions applicable to such services, and laid out forthwith. Funnel MasteryX reserves the right to change this site and these terms and conditions at any time.

Accessing, browsing, or otherwise using the site indicates you agree to all the terms and conditions in this agreement. Please read the terms and conditions carefully before proceeding.

By accessing this site, you, the customer, represent and warrant that you are at least 18 years old or are visiting the site under the supervision of a parent or guardian.

Subject to the terms and conditions of this agreement, Funnel MasteryX hereby grants you a limited, revocable, non-transferable, and non-exclusive license to access and use the site by displaying it on your internet browser only for the purpose of shopping for personal items sold on the site and not for any commercial use or use on behalf of any third party, except when explicitly permitted to do so by Funnel MasteryX in advance. Any breach of this Agreement shall result in the immediate revocation of the license granted in this paragraph without notice to you.

Except as permitted in the paragraph above, you may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile, or otherwise exploit this site or any portion of it unless expressly permitted by Funnel MasteryX in writing. You may not make any commercial use of any of the information provided on the site or make any use of the site for the benefit of another business unless explicitly permitted by Funnel MasteryX in advance.

Funnel MasteryX reserves the right to refuse service, terminate accounts, and/or cancel orders at its discretion, including, without limitation, if Funnel MasteryX believes that the customer’s conduct violates applicable law or is harmful to Funnel MasteryX's interests.

You shall not upload to, distribute, or otherwise publish through this site any content, information, or other material that(a) violates or infringes the copyrights, patents, trademarks, service marks, trade secrets, or other proprietary rights of any person;(b) is libelous, threatening, defamatory, obscene, indecent, pornographic, or could give rise to any civil or criminal liability under international law; or(c) includes any bugs, viruses, worms, trap doors, Trojan horses, or other harmful code or properties.

Funnel MasteryX may assign you a password and account identification to enable you to access and use certain portions of this Site. Each time you use a password or identification, you will be deemed to be authorized to access and use the site in a manner consistent with the terms and conditions of this agreement, and Funnel MasteryX has no obligation to investigate the authorization or source of any such access or use of the Site.

You will be solely responsible for all access to and use of this site by anyone using the password and identification originally assigned to you, whether or not such access to and use of this site is actually authorized by you, including, without limitation, all communications and transmissions and all obligations (including, without limitation, financial obligations) incurred through such access or use. You are solely responsible for protecting the security and confidentiality of the password and identification assigned to you. You shall immediately notify Funnel MasteryX of any unauthorized use of your password or identification or any other breach or threatened breach of this site’s security.

Training Course & Academy

1. DEFINITION AND INTERPRETATION

In these Terms, unless the context otherwise requires, the following expressions shall have the following meanings:

Agreement refers to a contract between the Customer and Funnel MasteryX for the purchase of Training.

Charges refers to the charges payable by the Customer for the Training, in accordance with clause 5 (Charges and Payment).

Customer refers to the person who is purchasing the Training from Funnel MasteryX.

Training refers to training services provided by Funnel MasteryX to the Customer, which is conducted either at a physical location or online.

Training Materials refers to any materials or documents provided or loaned by Funnel MasteryX and includes both hard copies, soft copies, and downloadable soft copy materials.

2. ACCEPTANCE OF BOOKING

(a) Once a booking is accepted, a confirmation will be sent by Funnel MasteryX to the Customer in the manner as may be decided by Funnel MasteryX.

(b) Customer shall make payment upon Funnel MasteryX's request before the confirmation will be sent.

3. SUPPLY OF THE TRAINING

3.1 Funnel MasteryX reserves the right to vary training dates, training presenters, or cancel training at any time, without incurring additional liability to the Customer. In such a situation, the Customer will be informed of the change prior to the training and will be entitled to cancel if they so choose, without penalty.

4. CUSTOMER’S OBLIGATIONS

4.1 Without the express written permission from Funnel MasteryX, Customers who have attended the full course shall not:

(a) transfer or share their account or seats with others;

(b) record the Training in any way;

(c) reproduce, scan, or copy, alter, modify, translate (in each case, whether in whole or in part) the Training Materials, except for the sole purpose of completing the Training under the permission of Funnel MasteryX; or

(d) upload any content to any individual or any party who did not subscribe to the course.

4.2 Funnel MasteryX reserves the right to revoke the membership and entitlement of the Customer who is in breach of this Agreement.

4.3 Funnel MasteryX also reserves the right to take legal action against such Customer who is in breach of this Agreement.

5. CHARGES AND PAYMENT:

5.1 All Training shall be paid in the manner as agreed or determined by Funnel MasteryX.

5.2 For bookings completed online, the Customer shall make payment in accordance with the directions provided on the website to Funnel MasteryX.

5.3 Failure by the Customer to pay any Charges when they fall due may (at Funnel MasteryX's discretion) result in:

(a) the allocation of the Customer’s place in the Training to others with no compensation to the Customer; or

(b) Funnel MasteryX canceling its Agreement with the Customer to provide the Training without incurring any liability.

5.4 Without prejudice to any other right or remedy that it may have, if the Customer fails to pay to Funnel MasteryX any sum due under this Agreement on the due date, the Customer shall pay interest on the overdue sum from the due date until payment of the overdue sum, whether before or after judgment. Interest under this clause will accrue daily at a rate of 5% per year or the highest rate allowed under the law, whichever is lower, without prejudice to Funnel MasteryX’s right to execute clause 5.3.

5.5 All sums payable to Funnel MasteryX under this Agreement:

(a) are exclusive of goods and services tax, sales and services tax, value-added tax, and other like taxes (but not including such taxes levied on Funnel MasteryX as corporate income taxes), and the Customer shall, in addition, pay an amount equal to any taxes chargeable on those sums, as determined by the tax authorities.

(b) shall be paid in full without any set-off, counterclaim, deduction, or withholding (other than any deduction or withholding of tax as determined by Funnel MasteryX.

5.6 All payments made by Customer are NON-REFUNDABLE, despite the Training not being attended by Customer unless the Training is canceled by Funnel MasteryX.

6. LIMITATIONS OF LIABILITIES

Funnel MasteryX shall not have any liability to the Customer for any losses or taxes to or of, or payable by any Customer arising out of or in connection with or related to the performance of the Training, and the Customer shall indemnify and keep Funnel MasteryX indemnified against all claims, fines, penalties, demands, proceedings, costs, and expenses whatsoever, which may be incurred or suffered by Funnel MasteryX in connection with or related to the performance of the Training.

7. TERMINATION

Without affecting any other right or remedy available to it, Funnel MasteryX may terminate the Agreement with immediate effect by giving written notice to the Customer if the Customer fails to pay any amount due under the Agreement on the due date for payment.

8. CONSEQUENCES OF TERMINATION

8.1 On termination or expiry of the Agreement for any reason, any provision of the Agreement that expressly or by implication is intended to come into or continue in force on or after termination of the Agreement shall remain in full force and effect.

8.2 Termination of the Agreement shall not affect any of the rights, remedies, obligations, or liabilities of Funnel MasteryX that have accrued up to the date of termination, including the right to claim damages in respect of any breach of the Agreement that existed at or before the date of termination.

Copyright

All text, graphics, photographs, or other images, button icons, audio clips, logos, slogans, trade names, or word software, and other contents on the website of Funnel MasteryX (collectively, “Content”), belong exclusively to Funnel MasteryX or its appropriate content suppliers. You may not use, reproduce, copy, modify, transmit, display, publish, sell, license, publicly perform, distribute, or commercially exploit any of the Content or otherwise dispose of any of the Content in a way not permitted by Funnel MasteryX, without Funnel MasteryX's express prior written consent. The use of data mining, robots, or similar data gathering and extraction tools on Funnel MasteryX, as well as the use of Funnel MasteryX trademarks or service marks in meta-tags, is strictly prohibited. You may view and use the Content only for your personal information and for shopping and ordering on the site and for no other purpose. The collection, arrangement, and assembly of all content on this site (the “Compilation”) belong exclusively to Funnel MasteryX. You may not use Funnel MasteryX's Content or Compilation in any manner that disparages or discredits Funnel MasteryX or in any way that is likely to cause confusion or violation of any applicable laws or regulations. All software used on this Site (the “Software”) is the property of Funnel MasteryX and/or its Software suppliers. The Content, the Compilation, and the Software are all protected under state, national, and international copyright laws. All rights not expressly granted are reserved by Funnel MasteryX. Violators will be prosecuted to the full extent of the law.

Intellectual Property Infringement Policy

It is the policy of Funnel MasteryX to take appropriate action where necessary to uphold and recognize all relevant State, Federal, and International laws in connection with material that is claimed to be infringing any trademark, copyright, patent, and all or any other intellectual property laws.

Termination and Effect of Termination

Except as otherwise provided in the standard terms of sale that govern each product on this site, this site, the products offered for sale on it, and the transactions conducted through it are provided by Funnel MasteryX on an “as is” basis. Funnel MasteryX makes no representations or warranties of any kind, expressed or implied, as to the operation of the site or the information, content, materials, or products included on this site except as provided here. To the full extent permissible by applicable law, Funnel MasteryX disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose, non-infringement, title, quiet enjoyment, data accuracy, and system integration. This site may include inaccuracies, mistakes, or typographical errors. Funnel MasteryX does not warrant that the content will be uninterrupted or error-free.

To the maximum extent permitted by law, Funnel MasteryX will not be liable for any damages of any kind arising from the use of this site, including, but not limited to, indirect incidental, punitive, exemplary, special, or consequential damages. To the maximum extent permitted by applicable law, Funnel MasteryX’s total liability to you for any damages (regardless of the foundation for the action) shall not exceed in the aggregate the amount of fees actually paid by you to Funnel MasteryX during the month immediately preceding the act allegedly giving rise to Funnel MasteryX’s liability.

Applicable Law

These conditions are governed by and interpreted in accordance with the laws of Malaysia, and Parties agree to submit to the exclusive jurisdiction of the courts in Malaysia.

Remedies

You agree that Funnel MasteryX’s remedy at law for any actual or threatened breach of this agreement would be inadequate and that Funnel MasteryX shall be entitled to specific performance or injunctive relief, or both, in addition to any damages that Funnel MasteryX may be legally entitled to recover, together with reasonable expenses of any form of dispute resolution, including, without limitation, attorneys’ fees. No right or remedy of Funnel MasteryX shall be exclusive of any other, whether at law or in equity, including, without limitation, damages, injunctive relief, attorneys’ fees, and expenses. No instance of waiver by Funnel MasteryX of its rights or remedies under these terms and conditions shall imply any obligation to grant any similar, future, or other waiver.
